1. Subject Matter and Scope of Application
These General Terms and Conditions of Sale govern the offer and sale of products sold on the colleadimari.com website via e-commerce.
They apply exclusively to purchases made online through the Site and constitute an integral part of every purchase order.
The Customer is required to carefully read these General Terms and Conditions of Sale before placing an order. Submission of the order implies full acceptance of these terms.
2. Seller’s Identity and Contact Information
The products sold on the website colleadimari.com are offered for sale directly by Azienda Agricola Colle Adimari, with its registered office in Italy, Via di Corliano 30 – 50050 Cerreto Guidi (FI), VAT No. 06570340486 (hereinafter: “Seller” or “Colle Adimari”).
For any requests for information, complaints, or assistance regarding purchases made on the Site, you may contact the Seller at the following contact details:
Email: info@colleadimari.com
Phone: +39 0571 55545
Mailing Address: Azienda Agricola Colle Adimari – Via di Corliano 30 – 50050 Cerreto Guidi (FI) – Italy
All communications regarding orders and complaints will be handled via email at the address provided by the Customer on the order form.
3. Customer Requirements and Sale of Alcoholic Beverages
The sale of products containing alcohol through the Site is reserved exclusively for individuals who have reached the legal drinking age under the laws of their country of residence, and in any case are at least 18 years of age.
By accessing the Site and placing an order, the Customer expressly declares that they are of the minimum age required to purchase alcoholic beverages and that they possess the full legal capacity necessary to enter into legally binding contracts.
Colle Adimari reserves the right to refuse or cancel orders for alcoholic products if there are reasonable grounds to believe that the Customer is not of legal age or that the information provided is incomplete, inaccurate, or clearly implausible.
Under no circumstances shall the Seller be held liable if, notwithstanding the foregoing, a minor succeeds in purchasing alcoholic products, without prejudice to the Seller’s commitment to cooperate with the competent authorities in the event of a report.
4. Products, Availability, and Images
The products offered for sale on the Site are those described and illustrated in the corresponding product pages published online.
The Seller undertakes to describe and present the products as accurately as possible. It is understood that any errors, inaccuracies, or minor differences in the descriptions, images, or graphic representations of the products shall not constitute grounds for liability on the part of the Seller, provided they do not affect the essential characteristics of the product itself.
The images and photographs of the products on the Site are for illustrative purposes only. Due to the technical characteristics of the devices used by the Customer to view the Site, the colors and appearance of the products may differ slightly from the actual products.
Product availability refers to actual availability at the time the Customer views the product page. However, this availability should be considered indicative and non-binding, as products may be sold to other customers before the order is confirmed or may be temporarily unavailable due to technical or inventory issues.
In the event of total or partial unavailability of one or more products after the order has been placed, the Customer will be promptly notified via email. In such cases, the Seller will proceed in accordance with the provisions of these General Terms and Conditions of Sale regarding orders, availability, and refunds.
Products sold by the bottle must be purchased exclusively in 6-bottle cases. It is not possible to purchase fewer than 6 bottles or a number of bottles that is not a multiple of 6.
This rule is dictated by considerations of safety and proper packaging during shipping: wine bottles are shipped exclusively in special 6-bottle boxes, designed to ensure maximum product protection and reduce the risk of breakage or damage during transport.
The purchasing process on the Website automatically prevents the completion of orders that do not meet these requirements.
5. Ordering Procedures and Conclusion of the Contract
To purchase one or more products on the Site, the Customer must select the products of interest, add them to the shopping cart, and complete the electronic ordering process by following the instructions provided on the Site.
Before submitting the order, the Customer is required to carefully verify the information entered, the contents of the shopping cart, and the final purchase summary, including the price of the products, any applicable taxes, shipping costs, and any other additional charges.
By submitting the order, the Customer confirms that they have read and accept these General Terms and Conditions of Sale, and that they undertake to pay the total price indicated in the order summary.
Upon receipt of the order, the Seller sends the Customer, to the email address provided during the purchase process, an order confirmation that constitutes notification of the conclusion of the contract on a durable medium.
The sales contract is therefore deemed concluded when the Customer receives this order confirmation via email. The order confirmation is sent automatically to the email address provided by the Customer at the time the order is placed.
The Seller reserves the right not to accept orders that are incomplete, incorrect, relate to unavailable products, or where there are reasonable grounds preventing the proper performance of the contract. In such cases, the Customer will be promptly notified by email, and any amount already charged or committed will be refunded or released via the payment method used.
6. Prices, Taxes, Duties, and Shipping Costs
All product prices listed on the Site are in Euros and, unless otherwise specified, are inclusive of VAT.
The applicable prices are those indicated on the Site at the time the Customer submits the order, subject to the provisions of this article in the event of a manifest error.
Shipping costs, as well as any additional applicable charges, are indicated separately during the purchase process and before the Customer submits the order.
For deliveries within the European Union, unless otherwise indicated, no customs duties are due. For any shipments to countries outside the European Union, any duties, import taxes, customs charges, or other additional costs required by the laws of the destination country are the responsibility of the Customer, unless otherwise expressly stated on the Website or in the order summary.
The Customer is required to carefully verify the final sale price before submitting the order.
Despite our constant attention to the information published on the Site, material errors, inaccuracies, or omissions regarding product prices or characteristics cannot be ruled out. In the event of a clear and recognizable error in a product’s price, the Seller reserves the right not to fulfill the order and to promptly inform the Customer, providing a refund or canceling any amount already paid.
If, however, the correct price of a product is lower than that indicated on the Website, the Customer will be charged only the lower price.
7. Payment Methods
Payment for products purchased on the Site may be made using the payment methods indicated during the checkout process. These methods may include, but are not limited to, credit cards, debit cards, PayPal, and other electronic payment systems that may be made available on the Site.
Payments are processed through third-party providers specializing in electronic payment services, selected by the Seller in accordance with appropriate security standards. Payment data transmitted by the Customer is processed directly by these providers via secure connections and is not stored in full on the Seller’s systems.
If the Customer chooses to pay via PayPal, the transaction will be processed through the PayPal platform and will be subject not only to these General Terms and Conditions of Sale but also to the applicable terms and conditions of the PayPal service.

The amount due will be charged in accordance with the timing and procedures established by the selected payment method and its provider. In the event of a declined authorization, a failed payment, or a subsequent cancellation of the transaction, the order cannot be processed.
If the Seller is required to issue a refund, it will be processed using, where possible, the same payment method used by the Customer for the purchase. The time required for the refund to be credited may vary depending on the banking network, the payment method used, and the payment provider’s procedures, and may take between 1 and 10 business days. These timeframes are beyond the Seller’s control.
8. Shipping, Delivery, and Inspection of Packages
Products purchased on the Site are shipped to the address provided by the Customer during the purchase process, via couriers selected by the Seller.
Any delivery times indicated on the Site or in the order confirmation are to be considered estimated and not binding, unless otherwise expressly agreed upon by the parties or as provided for by applicable regulations regarding the delivery of goods to consumers. In any case, the Seller undertakes to deliver the products without undue delay and in any event within a maximum period of 30 days from the conclusion of the contract, except in cases of force majeure or unforeseeable circumstances not attributable to the Seller.
Upon delivery, the Customer is required to verify, in the presence of the courier:
that the number of packages delivered matches the number indicated in the shipping documents;
that the packaging is intact, undamaged, dry, and otherwise unaltered;
that there are no obvious signs of breakage, tampering, or deterioration.
If the package shows visible abnormalities, the Customer is required to accept the delivery with specific reservation, clearly indicating the reason for the reservation (for example: “damaged package,” “wet packaging,” “open package,” or equivalent wording), or to refuse the delivery in the most serious cases.
Any damage, missing items, or anomalies found at the time of delivery or immediately after opening the package must be reported to the Seller promptly and in any case within a reasonable time from receipt, attaching, where possible, relevant photographic documentation.
Once the Customer, or a third party designated by the Customer other than the carrier, has physically received the products, the risk of loss or damage to the goods passes to the Customer, unless the carrier was chosen independently by the Customer and such choice was not proposed by the Seller.
9. Right of Withdrawal and Return Policy
The right of withdrawal is granted exclusively to Customers who qualify as consumers, meaning natural persons acting for purposes unrelated to any business, commercial, craft, or professional activity they may carry out.
The consumer has the right to withdraw from the purchase contract, without having to provide any reason and without penalty, within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the products. To exercise the right of withdrawal, the Customer must notify the Seller of their decision by means of an explicit statement sent to the contact details indicated in these General Terms and Conditions of Sale, within the period indicated above
Once the withdrawal has been communicated, the Customer is required to return the products within 14 days from the date on which they notified the Seller of their decision to withdraw from the contract.
The right of withdrawal does not apply in the cases provided for by applicable law and, in particular, in the following cases:
- products made to measure or clearly personalized at the Customer’s request;
- goods that are liable to deteriorate or expire rapidly;
- other cases of exclusion that may be provided for in Article 59 of the Consumer Code.
With regard to personalized products, the exclusion of the right of withdrawal applies only when the personalization is actual, significant, and carried out at the Customer’s specific request, and not in the case of simple standard variations or options already provided in the catalog.
Returned products must be stored, handled, and inspected with due care and returned intact, complete in all their parts, including any accessories, labels, and original packaging, if present. The Customer is liable for any decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, and functioning.
The return must be made in accordance with the instructions provided by the Seller following notification of withdrawal. Unless otherwise specified, the direct costs of returning the products are borne by the Customer.
10. Refunds
In the event of a valid exercise of the right of withdrawal, the Seller will refund the Customer all payments received in connection with the products subject to withdrawal, including any standard delivery charges incurred for the order. Any additional costs resulting from the Customer’s choice of a delivery method other than the standard one offered by the Seller are excluded from the refund.
Unless otherwise permitted by applicable law, the refund will be made within 14 days from the day on which the Seller was informed of the Customer’s decision to withdraw from the contract.
The Seller may, however, withhold the refund until the returned products are received or until the Customer has provided proof of shipment, whichever comes first.
The refund will be processed using, where possible, the same payment method used by the Customer for the initial transaction, unless expressly agreed otherwise and provided that this does not entail additional costs for the Customer.
The actual time required for the refund to be credited may vary depending on the payment method used, the banking system, and the procedures applied by the payment provider, and may take between 5 and 10 business days. These timeframes are not directly within the Seller’s control.
11. Legal Guarantee of Conformity
All products sold on the Site are covered by the legal guarantee of conformity provided for in Articles 129 et seq. of the Consumer Code, which grants the consumer the right to obtain, free of charge and within the limits of the law, repair or replacement of the goods, or a price reduction or termination of the contract with a corresponding refund, if the product does not conform to the contract.
A non-conforming product is defined as a product that:
is not fit for the purpose for which it is normally intended;
does not correspond to the description provided by the Seller or to the characteristics indicated in the product sheet;
does not possess the qualities and performance that the Consumer can legitimately expect.
The consumer has the right to invoke the statutory warranty for a period of 24 months from the date of delivery of the product.
The lack of conformity must be reported to the Seller within 2 months of the date on which it was discovered. Unless proven otherwise, if the defect is reported within 6 months of the product’s delivery, it is presumed to have existed at the time of delivery.
In the event of a lack of conformity, the Seller undertakes to restore the product’s conformity by repairing or replacing the item, provided this is possible within a reasonable timeframe and without significant inconvenience to the Customer. If repair or replacement is impossible, disproportionate, or cannot be carried out within a reasonable timeframe, the Customer may request a price reduction or termination of the contract with a full refund.
Any shipping costs necessary for the repair or replacement shall be borne by the Seller, unless the Customer has independently chosen a delivery method other than the standard one, with additional non-refundable costs.
12. Complaints and Customer Service
For any complaints, requests for information, or pre- or post-sales assistance regarding purchases made on the Site, the Customer may contact the Seller using the contact details provided in the “Seller’s Identity and Contact Information” section.
The Seller undertakes to respond to complaints and requests for information in a timely manner, clearly indicating how the matter will be handled (possible product replacement, refund, technical clarifications, etc.).
In the event of complaints regarding conformity defects, delivery issues, or situations falling within the scope of these General Terms and Conditions of Sale, the Customer is asked to provide their order number, the delivery date, and, where possible, photographic documentation useful for describing the problem.
Any communications and exchanges of documents between the Seller and the Customer shall be made in writing, preferably via email, and shall serve as evidence in the event of subsequent disputes.
13. Privacy and Reference to the Privacy Policy
The processing of personal data collected while browsing the Site and for the fulfillment of purchase orders is governed by the Privacy Policy of the Seller, published on the Site and accessible to the Customer at any time.
By placing an order on the Site, the Customer declares that they have read the privacy policy published on the Site, which is considered an integral part of these General Terms and Conditions of Sale for the purposes of managing the data necessary for the conclusion and execution of the contract, as well as the administrative and tax obligations associated with it.
The Privacy Policy contains information on:
who is the Data Controller;
the categories of data processed;
the purposes of the processing (order management, invoicing, post-sale communications, marketing, any additional purposes);
your rights (e.g., access, rectification, erasure, objection, etc.) and how to exercise them, including through the Seller.
14. Governing Law, Jurisdiction, and Alternative Dispute Resolution (ADR)
These General Terms and Conditions of Sale are governed by Italian law, except as otherwise provided by mandatory provisions applicable to the protection of consumers residing in other Member States of the European Union.
For any dispute regarding the interpretation, performance, or validity of these General Terms and Conditions of Sale, the competent court for the consumer Customer is determined in accordance with applicable consumer protection laws and jurisdictional rules governing distance contracts.
If the Customer is not a consumer, the court with exclusive jurisdiction is that of the place where the Seller has its registered office.
Consumers who wish to resolve a dispute out of court may contact the alternative dispute resolution (ADR) bodies competent under the applicable laws of their country of residence. For cross-border disputes regarding online purchases, the Customer may contact the European Consumer Centre (ECC-Net) in their country, which offers free assistance in resolving disputes with sellers established in another European Union member state. The European Consumer Centre Italy can be reached at: https://www.ecc-netitalia.it.
The use of alternative dispute resolution procedures is optional and does not affect the Customer’s right to pursue ordinary legal remedies.
15. Changes and Updates to the Terms and Conditions
The Seller reserves the right to modify, update, or supplement, in whole or in part, these General Terms and Conditions of Sale, including in light of any regulatory, technical, commercial, or functional changes relating to the Website and the services offered.
Any changes will take effect from the date of their publication on the Site and will apply exclusively to orders placed after that date.
The General Terms and Conditions of Sale applicable to each order are those accepted by the Customer at the time the order is placed.
The Customer is therefore encouraged to regularly review the updated text of these General Terms and Conditions of Sale before making any purchase on the Site.
